Chapter 7 If the bulk of your debt is unsecured consumer debt, such as credit cards and unsecured lines of bank credit, Chapter 7 can be used to discharge that debt. Most unsecured debts are dischargeable under Chapter 7, except student loans and some taxes. If you have secured debt, such as mortgaged property and financed vehicles, you must choose to return the property to the securing party or continue to make the payments. For many people, the relief from unsecured debt provides the breathing room needed to make payments on secured debt and keep the property. Chapter 13 A Chapter 13 plan, which is also referred to as a “wage earner plan,” is designed for individuals with a source of income, whether from work or any other source, because you will continue to make payments on your debt. Under Chapter 13, the court will extend the time for you to pay your debts, usually over a five-year period. At the end of the payment period, your remaining debt will be discharged. Chapter 13 is ideal for people with mostly secured debt because you can keep your property and make smaller monthly payments. We represent debtors and creditors in bankruptcy proceedings.
